The Cape Buy a Block and Get a Free EV promotion Terms and Conditions


1. Eligibility
The offer is provided on all Eligible Lots sold by Cape Paterson Ecovillage Pty. Ltd. (trading as ‘The Cape’), excluding lots resold
by private sellers and any lots with an asking price under $540,000. Lots that are excluded from this offer have house and land
packages available beginning at $899,000.


2. Offer Details
The offer includes provision to a qualified Purchaser of either a BYD Sealion 7 Performance, Tesla Model Y Rear-Wheel Drive or Kia
EV5 Earth, with no further upgrades, or an alternate fully electric vehicle valued at $68,990 driveaway or less.


3. Promotion Period
The offer is valid until either six lots are sold or 25 November 2025, whichever comes first.


4. Purchase and Settlement
To qualify for the offer, the Purchaser must Settle the lot purchase by 25 November 2025. The vehicle will be provided after the
settlement of the lot.


5. Offer Terms
• The maximum total retail value of The Cape Buy a Block and Get a Free EV offer is $68,990 inc GST.
• The offer is not transferable or redeemable for cash.
• The offer is valid for a BYD Sealion 7 Premium, Tesla Model Y Rear-Wheel Drive or Kia EV5 Earth with no options or upgrades
included, or a different fully electric vehicle valued at $68,990 driveaway or less.
• The offer is subject to availability, and The Cape reserves the right to modify or withdraw the offer at any time without prior notice
prior to the contract being signed.


6. Liability
The Cape is not responsible for any delays in vehicle delivery, or any issues related to the vehicle after purchase.
The Purchaser acknowledges that any issues, repairs, or disputes regarding the vehicle must be addressed directly with the vehicle
manufacturer or dealer.


7. Acceptance of Terms
By participating in this offer, the Purchaser acknowledges and agrees to these terms and conditions.


8. Changes to Terms and Conditions
The Cape reserves the right to change these Terms and Conditions from time to time. If this happens, we will notify you by posting
the new Terms and Conditions on our website. If you do not wish to be governed by the revised Terms and Conditions, you must not
make any further offers.


9. Governing Law
These Terms and Conditions are governed by and are to be construed in accordance with the laws of Victoria. You and The Cape
agree to the non-exclusive jurisdiction of the Courts of Victoria and waive any right to object to proceedings being brought in the
Victorian courts should any dispute arise.


10. Defined Terms
• “Eligible lot” means a lot sold by The Cape with an asking price of $540,000 or more, excluding lots resold by private sellers.
• “Settlement” means the completion of the purchase of the lot
• “Purchaser” means the individual or entity purchasing the lot.


11. Non-Compliance
If the purchaser fails to comply with any terms, they may forfeit the offer.


12. Force Majeure
The Cape is not liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire,
flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of
whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities,
nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout, or interruption or failure of electricity or
telephone service.


13. Dispute Resolution
Any disputes arising out of or in connection with these Terms and Conditions shall be resolved through good faith negotiations
between the parties. If the dispute cannot be resolved through negotiations, it shall be submitted to mediation or arbitration as
agreed by the parties.
